Estate Planning, Elder Law & Probate

Braun Kendrick attorneys help our clients plan for the efficient and orderly transfer of property after death. This includes helping clients select methods to transfer their estate to achieve the lowest overall tax burden. While tax planning is an important part of the process, our attorneys never lose sight of the fact that many personal decisions are involved in the estate planning process, and we work closely with our clients to assure that their wishes are carried out.

With estate and tax laws constantly in flux we closely follow all developments at the national and state level in order to keep informed of any legislative or court decisions that could impact estate planning and taxation. We specialize in ways to capitalize on tax advantages and business planning for transfers of closely held businesses and ways to use irrevocable life insurance trusts to fund estate tax liability and provide estate liquidity.

In addition to estate planning functions, we are also experienced in estate administration, both in the probate courts and in transfers by trust. The department’s attorneys handle both formal and informal probate proceedings, and they represent beneficiaries’ interests or the interests of personal representatives in adversary proceedings, such as will contests, will construction suits, and tax disputes before the IRS and in court.
